1. Agreement to Terms

These Terms of Service ("Terms," "Agreement") constitute a legally binding agreement between you ("User," "you," or "your") and GymFroog ("we," "us," or "our") governing your access to and use of the GymFroog mobile application ("App," "Service").

By using the App, you represent and warrant that:

• You are at least 13 years old (or 16 in the European Union)
• You have the legal capacity to enter into these Terms
• If you are under 18, you have obtained parental/guardian consent
• You will comply with these Terms and all applicable laws

2. Description of Service

GymFroog is a mobile fitness tracking application designed to help users:

• Track Workouts: Log exercises, sets, reps, weights, and workout duration
• Manage Programs: Create and customize weekly training programs
• Monitor Progress: Track body measurements, performance metrics, and personal records
• Receive Recommendations: Get AI-powered workout suggestions based on your history and goals
• Access Exercise Library: Browse 500+ exercises with instructions and demonstrations
• Sync Across Devices: Access your data from multiple devices (with internet connection)
• Work Offline: Use core features without internet connectivity

Service Availability

The App is available for download on:

• Google Play Store (Android devices)
• Apple App Store (iOS devices)

Free Service

GymFroog is currently offered as a free service. We reserve the right to introduce premium features or subscriptions in the future, with advance notice to users. The core functionality will remain free.

3. User Accounts and Registration

3.1 Account Creation

To use GymFroog, you must create an account by providing:

• A valid email address
• A secure password
• Optional: Google account authentication (OAuth)

Account Requirements:

• Age: You must be at least 13 years old (16 in EU) to create an account
• Accuracy: All information must be accurate, current, and complete
• One Account: You may only create one account per email address
• Personal Use: Accounts are for personal, non-commercial use only

3.2 Account Security

You are responsible for:

• Password Security: Maintaining the confidentiality of your password
• Account Activity: All activities that occur under your account
• Unauthorized Access: Immediately notifying us of any unauthorized use at contact@gymfroog.com
• Security Breaches: Reporting any security vulnerabilities you discover

We are NOT liable for any loss or damage arising from your failure to comply with security obligations.

3.3 Account Termination and Deletion

Voluntary Termination: You may delete your account at any time through:

• In-App: Profile > Settings > Privacy & Data > Delete Account
• Email: Send request to contact@gymfroog.com

Termination by Us: We reserve the right to suspend or terminate your account if:

• You violate these Terms
• You engage in fraudulent, abusive, or illegal activity
• Your account remains inactive for an extended period (after notice)
• Required by law or law enforcement

4. Acceptable Use Policy

When using GymFroog, you agree to comply with all applicable laws and these usage restrictions.

Prohibited Activities

You agree NOT to:

• Illegal Use: Use the App for any unlawful purpose or in violation of any local, state, national, or international law
• Unauthorized Access: Attempt to gain unauthorized access to the App, other user accounts, or our systems
• Reverse Engineering: Decompile, disassemble, reverse engineer, or attempt to extract source code from the App
• Circumvention: Bypass, disable, or interfere with security features or access controls
• Automated Access: Use bots, scrapers, or automated systems to access the App without written permission
• Data Mining: Extract, scrape, or harvest data from the App or other users
• Interference: Introduce viruses, malware, or any code that disrupts or damages the App
• Impersonation: Impersonate any person or entity, or falsely represent affiliation with any person or entity
• False Information: Provide false, misleading, or inaccurate information
• Spam: Send unsolicited communications, spam, or chain messages
• Abuse: Harass, threaten, or harm other users
• Copyright Infringement: Upload, post, or share content that infringes intellectual property rights

Enforcement

Violation of these terms may result in:

• Immediate account suspension or termination
• Removal of violating content
• Legal action if warranted
• Cooperation with law enforcement

5. Health and Fitness Disclaimer

IMPORTANT HEALTH NOTICE: Please read this section carefully as it affects your legal rights and responsibilities.

5.1 Not Medical Advice or Medical Device

GymFroog is NOT:

• A medical device or health monitoring device
• A substitute for professional medical advice, diagnosis, or treatment
• Designed to diagnose, treat, cure, or prevent any disease or medical condition
• A substitute for consultation with qualified healthcare professionals

Content is For Informational Purposes Only: All content, features, suggestions, and recommendations provided by the App are for general informational and educational purposes only. They should not be relied upon as medical advice.

5.2 Consult Healthcare Professionals

Before starting any fitness program, you should:

• Consult with a physician or qualified healthcare provider
• Disclose any pre-existing medical conditions, injuries, or physical limitations
• Obtain medical clearance if you have cardiovascular, musculoskeletal, or other health concerns
• Follow your healthcare provider's recommendations

Seek Immediate Medical Attention if you experience:

• Chest pain or discomfort
• Severe shortness of breath
• Dizziness, lightheadedness, or fainting
• Severe joint or muscle pain
• Any unusual or concerning symptoms

5.3 Use at Your Own Risk

Exercise Risks: Physical exercise and fitness activities involve inherent risks of injury, including but not limited to:

• Muscle strains, sprains, and tears
• Joint injuries
• Cardiovascular events
• Accidents from equipment use
• Aggravation of pre-existing conditions

YOU ASSUME ALL RISKS associated with using the App and following any workout programs, exercises, or recommendations.

5.4 Listen to Your Body

• Start slowly and progress gradually
• Stop immediately if you experience pain, discomfort, or unusual symptoms
• Rest adequately between workouts
• Stay hydrated and maintain proper nutrition
• Use proper form and technique

5.5 No Guarantee of Results

We make no guarantees, representations, or warranties regarding:

• Fitness results or improvements
• Weight loss or body composition changes
• Achievement of specific fitness goals
• Timeframes for results

Individual results vary based on numerous factors including genetics, diet, consistency, effort, and pre-existing conditions.

5.6 Liability Waiver

BY USING THIS APP, YOU ACKNOWLEDGE AND AGREE THAT:

• You use the App entirely at your own risk
• We are not responsible or liable for any injuries, damages, or adverse health effects
• You release us from all claims, demands, and damages arising from your use of the App

6. User Content and Data

6.1 Your Content

You retain ownership of content you create, including:

• Workout logs and exercise data
• Custom training programs
• Progress photos (if uploaded)
• Notes and comments
• Custom exercises you create

6.2 License Grant

By creating content in the App, you grant us a limited, non-exclusive, royalty-free license to:

• Store and process your content to provide the Service
• Create aggregated, anonymized statistics (not personally identifiable)
• Backup and secure your data

We will NOT: Share, sell, or publicly display your personal workout data without your consent.

6.3 Content Responsibility

You are solely responsible for:

• The accuracy and legality of your content
• Ensuring your content doesn't infringe third-party rights
• Backing up your own data (we provide export functionality)

7. Intellectual Property Rights

7.1 Our Intellectual Property

All intellectual property in the App, including but not limited to:

• App design, layout, and user interface
• Software code, algorithms, and architecture
• Exercise database, descriptions, and content
• Graphics, images, icons, and logos
• Text content and documentation
• Trademarks: "GymFroog" name and logo

...are owned by us or our licensors and protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Limited License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and use the App for personal, non-commercial purposes
• Access and use features available to your account type

You may NOT:

• Copy, modify, or create derivative works of the App
• Sell, rent, lease, or sublicense the App
• Remove, alter, or obscure any proprietary notices
• Use our trademarks without written permission

8. Third-Party Services and Links

8.1 Third-Party Service Providers

The App integrates with third-party services:

• Firebase (Google LLC): Authentication, database, analytics, cloud functions
• Google AdMob: Advertising services
• Google OAuth: Optional Google sign-in functionality

Your use of third-party services is at your own risk. We are not responsible for third-party services, content, or practices.

We display advertisements via Google AdMob:

• You can manage ad preferences in Privacy Settings

9. Disclaimers and Limitations of Liability

9.1 "AS IS" Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• Merchantability: Fitness for sale or use
• Fitness for a Particular Purpose: Suitability for your specific needs
• Non-Infringement: Freedom from intellectual property violations
• Accuracy or Reliability: Correctness of information or features
• Availability: Uninterrupted or error-free operation
• Security: Freedom from viruses or harmful components

We do not warrant that:

• The App will meet your requirements or expectations
• The App will be available at all times or without interruptions
• Errors or defects will be corrected
• The App is free from harmful components

9.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WE BE LIABLE FOR:

• Indirect Damages: Loss of profits, revenue, data, goodwill, or business opportunities
• Consequential Damages: Costs of substitute services, downtime, or business interruption
• Incidental Damages: Unforeseen costs or losses
• Punitive or Exemplary Damages
• Personal Injury or Property Damage: Arising from your use of the App (except where prohibited by law)
• Third-Party Actions: Actions or content of other users or third parties

Maximum Liability: Our total liability for all claims arising from your use of the App shall not exceed the greater of (a) €100 or (b) the amount you paid us in the 12 months preceding the claim (if applicable).

Jurisdictional Limitations: Some jurisdictions do not allow certain limitations on warranties or liability. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

9.3 Indemnification

You agree to indemnify, defend, and hold harmless GymFroog, its officers, directors, employees, and agents from any claims, liabilities, damages, losses, costs, or expenses (including legal fees) arising from:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of third-party rights (including intellectual property rights)
• Your violation of applicable laws
• Your content or data submitted to the App

10. Modifications to the Service and Terms

10.1 Changes to the App

We reserve the right at any time to:

• Modify, suspend, or discontinue any feature or the entire App
• Update, change, or remove content
• Change pricing (with advance notice if introducing paid features)
• Impose limits on features or storage

We are not liable for any modifications, suspensions, or discontinuations of the Service.

10.2 Changes to These Terms

We may update these Terms from time to time. Changes may be made due to:

• Legal or regulatory requirements
• New features or services
• Security or safety reasons
• Clarification or correction of ambiguities

Notice of Changes:

• Material Changes: We will notify you via email and/or in-app notification at least 30 days before changes take effect
• Minor Changes: We will update the "Effective Date" at the top of this document

Your Options: If you disagree with changes, you may delete your account before the changes take effect. Continued use of the App after changes constitute acceptance of the updated Terms.

11. Governing Law and Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of France, without regard to conflict of law provisions.

11.2 Jurisdiction

Any disputes arising from these Terms or your use of the App shall be subject to the exclusive jurisdiction of the courts of France, unless otherwise required by applicable consumer protection laws in your jurisdiction.

11.3 Informal Resolution

Before filing any formal claim, you agree to contact us at contact@gymfroog.com to attempt to resolve the dispute informally. We will make good faith efforts to resolve disputes amicably.

11.4 Class Action Waiver

To the extent permitted by law, you agree that any dispute will be resolved on an individual basis and not as a class action, consolidated action, or representative action.

12. International Use and Export Compliance

12.1 International Users

The App is operated from France. If you access the App from outside France:

• You do so at your own initiative and risk
• You are responsible for compliance with local laws
• Data may be transferred to and processed in France, the United States, or other countries

12.2 Export Controls

You agree to comply with all applicable export and import control laws and regulations. You shall not export or re-export the App to prohibited countries or entities.

13. Miscellaneous Provisions

13.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and us regarding the App and supersede all prior agreements.

13.2 Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect.

13.3 Waiver

Our failure to enforce any right or provision of these Terms shall not be deemed a waiver of such right or provision.

13.4 Assignment

You may not assign or transfer these Terms or your account without our prior written consent. We may assign these Terms at any time without notice.

13.5 Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including natural disasters, war, terrorism, pandemics, government actions, or internet/telecommunications failures.

13.6 Language

These Terms are provided in English. If translated to other languages, the English version shall prevail in case of any discrepancies.
